Medspa Policies

We understand that unforeseen circumstances may occur that interfere with your appointment time. Due to the high demand of our services, we ask that you provide 24 hours notice for any appointment changes or cancellations. Any appointment cancelled within 24 hours of your service will be subject to a $75 fee.

We reserve a room and service provider time for you at the time of your booking. Therefore, if you do not arrive at your appointment and have not cancelled your service within the 24 hours cancellation period, we may charge the full service price to the payment method on file. We will make several attempts via email and text to confirm in advance of your appointment time.

While we make every effort to make our customers as happy as possible, all service sales are final. We are a small business and unfortunately cannot offer refunds on any used or unused appointments/sessions for individual services, service packages or service series.

Gift Cards may be purchased at the Boutique or online. They may be used towards any boutique product or service. Gift Card must be present at time of purchase/usage. Lost or stolen Gift Cards cannot be redeemed or replaced. Gift Cards do not expire unless promotional. Promotional cards cannot be combined with any discounted services/products, packages, or series. All sales are final. Gift Cards cannot be redeemed for cash.

While our goal at Simple Radiance Medspa  is to make sure our product recommendations will work for you, sometimes your skin might not react as expected. We work with you to choose the best products based on their skincare needs. If you have received a skincare consultation or treatment from Simple Radiance Medspa, we welcome your slightly used product as a return if it did not work for you. You may choose another product or get a full refund in the form of credit. Cash back is not available. However, if you have not received a treatment or consultation from Simple Radiance Medspa prior to purchasing a product, we are sorry to say that we cannot accept any returns (used or unused).

All online purchases are final. Please note, if ordering online, be mindful that if this is a new product for you, it might not work on your skin. If it doesn’t work for you, please consider giving the product to someone else who may benefit and/or come in for a skin evaluation or treatment if you haven’t had one, and we can make a product recommendation for you to purchase in the spa.

All orders are shipped USPS Priority mail with tracking between 2-3 business days from shipping date within the United States. There is a flat fee $9.95 for up to two items and $13.75 for three items or more.  You will receive an email notification when your item(s) ship. International shipping is not available.

We encourage resolving disputes informally before initiating formal legal action. Prior to submitting any dispute or claim to arbitration, you and we agree to make a good faith effort to resolve the issue informally.

To begin this informal resolution process, you agree to notify us in writing by email at [email protected] about the nature of the dispute, the basis for your claims, and the resolution you are seeking, including any monetary amount. Provide as much detail as possible so we can fully understand the dispute.

Within 60 days of receiving your notice, you agree to engage in good faith efforts to resolve the dispute, including personally participating in a minimum of one telephone or videoconference with us. You may have a lawyer attend the call if you wish. If the dispute is not resolved within that 60-day period (which can be extended by mutual agreement), either you or we may commence arbitration to resolve the matter consistent with the process outlined below.

Completing this informal dispute resolution process is a required precondition to starting arbitration. You and we agree to pause any applicable statute of limitations and filing fee deadlines while engaged in this informal process, from the date we receive your notice until an arbitration commences or the 60-day period ends, whichever is sooner. A court shall have the authority to enforce this pre-arbitration requirement, including the power to prevent the filing of an arbitration demand.

You and we agree to resolve any controversies, claims, counterclaims, or other disputes between you and Simple Radiance Medspa or you and a third-party agent of the Simple Radiance Medspa (a “Claim”) through final and binding arbitration instead of through court proceedings. This arbitration agreement applies to any existing or future Claims that you have not already filed in court or arbitration prior to agreeing to these Terms of Use.

The arbitration will be conducted in accordance with the Consumer Arbitration Rules of the American Arbitration Association (“AAA Rules”), which are available at www.adr.org or by calling 1-800-778-7879. You and we hereby waive any right to a jury trial of any Claim. The arbitrator’s decision will be final and binding and may be enforced in any court of competent jurisdiction.

The parties agree that the arbitration proceedings will be kept confidential, except as may be required by law or securities regulations. The Federal Arbitration Act and federal arbitration law apply to this agreement.

To begin arbitration, you must send us a signed letter describing your Claim at least 10 days before initiating the arbitration. Offers of compromise will be adjudicated under the Texas Civil Practice and Remedies Code.

If the arbitration costs are prohibitive compared to litigation, the ——- will pay the necessary administrative and arbitrator fees. The arbitrator may also apportion the final costs as appropriate.

This agreement does not preclude you or Simple Radiance Medspa from seeking action by government agencies. You also have the right to bring qualifying claims in small claims court. Either party may elect to proceed exclusively in small claims court.

Neither you nor Simple Radiance Medspa may act as a class representative or participate in a class action for any Claim. The arbitrator can only decide individual Claims.

If any part of this arbitration agreement is found invalid, the rest will remain in full force. The arbitrator may award the same relief available in court, except for “public injunctions” which may only be awarded by a court.

This arbitration agreement will survive the termination of your relationship with Simple Radiance Medpsa.
